1. Acceptance
For the hosted service, by creating an account or accessing the service you agree to these Terms and our Privacy Policy. For the local desktop apps, you agree to these Terms by installing or using the software. If you use the services on behalf of an organization, you represent that you have authority to bind that organization. Pilot recipients are governed primarily by their separate pilot agreement, with these Terms filling any gap it doesn't address.
2. Services
MOBLUEHQ provides AI verification infrastructure and related software, offered in three forms: (a) downloaded, locally-run desktop applications (blueMonster, blueGlu) that operate wholly on your device except where you enable a cloud or bring-your-own-key feature; (b) a hosted service (blueMonster Premium, and cloud-tier features of blueMonster Pro / blueGlu) that runs on our infrastructure; and (c) evaluation software distributed under a separate pilot agreement. Features, limits, and availability depend on your plan and product. We may modify features with reasonable notice where practicable.
3. Accounts
Where an account is required (hosted service, paid tiers), you are responsible for safeguarding credentials and for activity under your account. Notify us promptly of unauthorized use. We may suspend accounts that pose security or abuse risk. The local/free tier does not require an account.
4. Acceptable use
You may not use the services or software to violate law, infringe rights, transmit malware, attempt unauthorized access, or interfere with other users or our infrastructure. You may not circumvent license entitlement or metering logic. You may not use outputs to automate high-risk decisions in regulated contexts without appropriate human oversight unless your agreement expressly permits it, and you may not represent any output as a patentability opinion, a determination that an idea is new, or a freedom-to-operate opinion — see our Product Disclaimers for the full wording and why it matters.
5. Customer content
Hosted service: you retain ownership of content you submit; you grant MOBLUEHQ a limited license to host, process, and display it solely to provide and improve the service, consistent with the Privacy Policy.
Local desktop apps: in local/free mode, you submit no content to us — your inputs and outputs stay on your device. Where you enable a cloud or bring-your-own-key feature, the portion of your work sent to that third-party provider is governed by that provider's own terms as well as ours; see our Privacy Policy and Trust page.
Pilot software: governed instead by the confidentiality clause of the applicable pilot agreement.
6. Intellectual property
MOBLUEHQ retains all rights in the services, software, and branding. No rights are granted except as expressly stated. Feedback may be used without restriction or compensation. No trademark is currently registered for any MOBLUEHQ product name; nothing here or elsewhere should be read as representing otherwise.
7. Privacy
Our collection and use of personal information is described in the Privacy Policy. The current subprocessor list — which vendor receives data, what it receives, and for which product — is on our Trust page.
8. Disclaimers
THE SERVICES AND SOFTWARE ARE PROVIDED “AS IS.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOBLUEHQ DISCLAIMS ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. VERIFICATION OUTPUTS ARE DECISION SUPPORT — NOT LEGAL, MEDICAL, OR FINANCIAL ADVICE.
Our full Product Disclaimers page — covering what our outputs do and don't establish, what a signed receipt does and doesn't prove, and each product's own limitations — is incorporated into these Terms by reference and applies to every product's outputs under this Agreement.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOBLUEHQ WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR DATA. OUR AGGREGATE LIABILITY ARISING FROM THESE TERMS OR THE SERVICES WILL NOT EXCEED THE GREATER OF (A) AMOUNTS YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS.
10. Subscription and billing
This section is intentionally not yet in force. MOBLUEHQ does not currently process subscription payments — checkout and metered billing are planned but not live. Auto-renewal disclosure, cancellation mechanics, and whether prepaid credits may expire are consumer-protection questions with real statutory content that vary by state, and they have not yet been reviewed by a licensed attorney. No subscription, auto-renewal, or credit-expiration terms are published here, and none should be inferred from the absence of a policy. Before any paid subscription is offered, this section will be replaced with reviewed terms, and the effective date will be updated accordingly.
11. Suspension and termination
Either party may terminate for material breach not cured within thirty days of notice. We may suspend or terminate immediately for abuse or legal risk. For the local desktop apps, termination means license revocation rather than account suspension. Upon termination, your right to use the services ends; sections that by nature should survive will survive.
12. Governing law
These Terms are governed by the laws of the State of Delaware, excluding conflict-of-law rules. Exclusive venue lies in state or federal courts located in Delaware, unless applicable law requires otherwise.
13. Changes
We may update these Terms. Material changes will be communicated with reasonable notice. Continued use after the effective date constitutes acceptance. The version string recorded at signup identifies which terms you accepted.
